Judgment

ORDER Heard the learned counsel for the petitioner and the learned Government Advocate for the respondents.

¶2This Revision Petition has been filed on very limited grounds in view of the reason that steps are being taken by the respondents to recover the interest component on the amounts recovered from a different Co-operative Societies, which allegedly resulted on account of dereliction of duty on the part of the revision petitioner. The revision petitioner has already filed CMA.(CS)., and the same is pending before the Principal District Judge, Salem (Special Tribunal for Co-operative Cases). Though the petitioner has filed an application for interim stay along with the said appeal, the said application has not been taken up. However, after lapse of two years, in August 2025, the respondents are taking steps to recover the amounts due and also issued a Charge memo to the revision petitioner.

¶3Considering the pendency of the appeal for a period of more than two years and also request made for an interim stay by the revision petitioner, I am inclined to dispose of the CRP in the manner following:-

(i)CMA(CS)., which is pending before the Principal District Judge, Salem (Special Tribunal for Co-operative Cases) filed under Section 152 of the Tamil Nadu Cooperative Societies Act, 1983 shall be disposed of on merits and in accordance with law, on or before 31.03.2026. In the meantime, no coercive steps shall be initiated against the revision petitioner.

¶4It is brought to my notice of the learned counsel for the petitioner, the respondents are likely to deduct a sum of Rs.40,000/- from the salary payable to the petitioner from today.

¶5In view of the above fact, the learned Government Advocate appearing for the respondents shall immediately inform the concerned authorities not to deduct any amount in view of the order passed by this Court.

¶6This Civil Revision Petition is disposed of. No costs. Consequently, connected Civil Miscellaneous Petitions are closed.
