Futarmal (Huf) v. The Administartor General and Official Trustee of Tamil Nadu

ORDER The present application has been instituted to direct the 1st respondent to refund an amount of Rs.50 lakhs paid by the appellant to the 2nd respondent Trust.

¶2Based on the understanding between the appellant and the 2nd respondent Trust, a sum of Rs.50 lakhs appears to be transferred from the applicant to the 2nd respondent Trust.

¶3The learned AG & OT would submit that no lease/contract has been executed between the applicant and AG & OT. The subject property vests with AG & OT. The property was neither leased out to the applicant nor to the 2nd respondent Trust. Thus, a private understanding/agreement between the applicant and the 2nd respondent will not have any bearing on the AG & OT and on that basis the application filed is not entertainable. Page3 of 5

¶4Since there is no jural relationship between AG & OT/Receiver and the applicant, the present petition is not maintainable. However, the applicant is at liberty to work out their reedy in the manner known to law.
