S.Chandrasekar v. L.Lialliammal and 10 Others

ORDER This application has been filed by the applicant/petitioner under Order XIV Rule 8 of the Original Side Rules read with Order I Rule 10(2) CPC, seeking to implead the proposed respondents as parties in O.P.No.137 of 2024.

¶2The main Original Petition has been filed for grant of Letters of Administration with the Will annexed in respect of the Will dated 13.04.2015 said to have been executed by late K.V.Kannappan. The testator was unmarried.

¶3The applicant/petitioner S.Chandrasekar claims to be the younger brother's son of the testator and also the sole beneficiary under the Will dated 13.04.2015. The petitioner has stated that the testator had no wife or children and that the property was bequeathed to him under the said Will.

¶4By order dated 06.11.2024 this court, directed the petitioner to implead the Class-II heirs as disclosed in the genealogy map filed on 29.10.2024. Pursuant to the said direction, the present application has been filed.

¶5The 10th proposed respondent has filed a counter affidavit on his behalf and also on behalf of the other proposed respondents. Though objections have been raised regarding the genuineness of the Will, alleged suppression and pendency of partition proceedings, the proposed respondents have not seriously opposed their impleadment.

¶6Considering the nature of the testamentary proceedings and the fact that the proposed respondents claim caveatable interest in the estate of the deceased testator, this Court is of the view that their presence is necessary for proper adjudication of the main O.P.

¶7The proposed respondents, namely, L.Lilliammal, D.Rani, K.Saraswathy, M.Kala, Hemalatha, M.Shantha Kumari, L.Parvathy, Mrs.Pushpa, A.Devi, K.Babu and K.Saravanan are ordered to be impleaded as respondents in O.P.No.137 of 2024.
