Judgment
ORDER This Original Petition has been filed by the petitioners seeking grant of a Succession Certificate in respect of the debts and securities forming part of the estate of late Mr.S.Jayaraman, who died intestate on 21.08.2021 at Virugambakkam, Tamil Nadu 600 092, while ordinarily residing at Plot No.57, New No.23, Venkatesa Nagar Extn, 1st Stret, Virugmabakkam, Chennai-600 092, within the jurisdiction of this Court. The petitioners have stated that a diligent search was made for a Will, but no Will was found and, to their knowledge, the deceased died intestate.
¶2The first petitioner, Ms.Padma Jayaramam, is the wife of the deceased. The second petitioner, Mr J. Vijay, is the son of the deceased, and the third petitioner, Miss. J. Vijaya Shree is the daughter of the deceased. The mother of the deceased, had predeceased him. Thus, the petitioners are stated to be the surviving Class-I legal heirs of the deceased.
¶3It is the case of the petitioners that the deceased left behind the debts and securities more fully described in the Schedule to the petition and that the Succession Certificate is required for collecting the amounts due and for receiving the interest and dividends and for dealing with the securities standing in the name of the deceased. The second and third petitioners, being the other surviving legal heirs of the deceased, have filed their respective consent Page3 of 6 affidavits, expressing their no objection to the grant of the Succession Certificate in favour of the first petitioner.
¶4In support of the petition, the first petitioner, Ms. Padma Jayaraman, examined herself as P.W.1 before the learned Master.
¶5On behalf of the petitioners, Exs.P1 to P5 have been marked. Ex.P1 is the computer-generated Death Certificate of the deceased; Ex.P2 is the computer generated legal heirship certificate of (late) S.Jayaraman; Exs.P3 is the statements of shareholdings standing in the name of the deceased with the respective financial institutions; Ex.P4 is the photocopy of the paper publication effected in the Tamil daily Makkal Kural dated 29.01.2026; and Ex.P5 is the certificate filed under Section 63(4)(c) of the Bharatiya Sakshya Adhiniyam.
¶6The evidence of P.W.1, coupled with Exs.P1 to P5, establishes the death of late Mr S.Jayaraman, the identity of his surviving legal heirs and the debts and securities standing in his name. The Legal Heir ship Certificate and the statements of shareholdings support the case of the petitioners about the estate in respect of which the Succession Certificate is sought.
¶7The paper publication effected in Makkal Kural dated 29.01.2026 has been marked as Ex.P4 and no objection has been brought to the notice of this Court pursuant to the said publication. Further, the second and third petitioners, who are the other surviving legal heirs, have expressly consented to the issuance of the Succession Certificate in favour of the first petitioner. ¶8On consideration of the pleadings, oral evidence and documentary evidence placed on record, this Court is satisfied that the first petitioner, Ms.Padma Jayaraman, is entitled to the grant of a Succession Certificate in respect of the debts and securities specified in the Schedule to the petition.
¶9In the result, this Original Petition is allowed.
