For Petitioner : Mr.R.Bharath Kumar (both WPs) For Respondents : Mr.U.Baranidharan (both WPs) Special Government Pleader for R1 to R3 Mr.V.Gopalsamy [R4]

COMMON ORDER These petitions have been filed to modify the order passed by this Court on

21.04.2025 in W.P.Nos.40053 of 2024 and 6510 of 2025.

¶2When these petitions came up for hearing on 19.12.2025, this Court passed the following order: "These modification petitions have been filed on the ground that the sisters of the petitioner are not cooperating for execution of the rectification deed and as a result, the petitioner is not in a position to execute the settlement deed in favour of his wife.

¶2The main grievance that has been expressed by the petitioner is that an extent of 1.57 acres belonging to the fourth respondent was inadvertently included in the schedule of property when the release deed was executed by the sisters of the petitioner. The petitioner was willing to delete the extent of 1.57 acres by means of a rectification deed. However, the sisters of the petitioner, who executed the release deed, are not cooperating. Hence, if ultimately the petitioner does not include 1.57 acres of land belonging to the fourth respondent in the settlement deed that is now sought to be executed in favour of the petitioner's wife and a clear recital to that effect is also included in the settlement deed, the fourth respondent may not have any grievance.

¶3In view of the above, the learned counsel for petitioner is permitted to serve notice on the counsel who appeared on behalf of the fourth respondent in the writ petition. Private notice shall also be sent to the fourth respondent returnable by 23.01.2026.

¶4Post these petitions on 23.01.2026. Registry is directed to print the name of the learned Government Advocate appearing on behalf of the respondents 1 to 3 and the name of the fourth respondent or his counsel in the cause list."

¶3In line with the above order, the settlement deed has been drafted and the relevant clause has been included. For better appreciation, the same is extracted hereunder: @nkw;go g[Jg;gl;o fpuhk rh;nt vz;/43-1A1 g[";ir Vu;!; 0/6/35f;F jPu;it 1/75 ,J g{uht[k; ,J Vf;fu; fzf;fpy ; 1/57 brz;l ; epyKk ; ,J u';frhkp kfd; g{ghy ; kw;Wk ; mtupd ; FLk;g egh;f;F brhe;jkhdJ/ v';fSila ghf ghj;jpa mf;F tpLjiy D.No.10454-2015?y;'jtWjyhf gjpt['bra;g;gl;L cs;sJ/ vdnt v';fSf;Fk;'v';fSila

¶4The learned counsel for the 4th respondent submitted that, since the property belonging to the 4th respondent has not been included in the settlement deed, the 4th respondent will not have any objections the petitioner in presenting the settlement deed for registration and registering the same.

¶5In view of the above, the order passed by this Court in W.P.Nos.40053 of 2024 & 6510 of 2025 dated 21.04.2025 is modified. The petitioner is permitted to present the modified settlement deed for registration before the 3rd respondent and the same shall be entertained and registered, if it is otherwise in order. These petitions are disposed of in the above terms. No costs.
