Judgment

Order This Writ Petition has been filed to direct the 2nd respondent to issue No Objection for grant of patta by considering the representation of the petitioner dated 25.9.2023 in respect of the petitioner's land.

¶2The learned counsel for the petitioner submitted that the petitioner is the owner of the land bearing a part of Plot No. 71, Thirupathi Nagar, Sridevi Kuppam, Valasaravakkam, Chennai 600 087, comprised in S.F. Nos. 50/2, 51/2, and 52, measuring an extent of 1,190 sq. ft., wherein the petitioner constructed a residential building and is in absolute possession and enjoyment of the same. On 30.01.2019, the petitioner applied for the grant of patta in his name. However, in the proceedings of the 3rd respondent dated 21.04.2023, it was stated that the subject land relates to S.F. Nos. 50/2, 51/2, and 52/1, out of which S.F. No. 50/2A1A stands in the name of Kandhasamy, and the other two survey numbers, i.e., 51/2 and 52/1, stand in the name of the Tamil Nadu Housing Board, the 2nd respondent herein. Therefore, while patta has been issued in favour of the petitioner in respect of S.F. No. 50/2, the petitioner's Page3 of 5 application with regard to the other two survey numbers was rejected by the Tahsildar, who further directed the petitioner to obtain a "No Objection Certificate" (NOC) for the issuance of patta. Hence, the petitioner sent a representation dated 25.09.2023, requesting the issuance of an NOC for patta in respect of S.F. Nos. 51/2 and 52/1. Since the said representation has not been considered, the petitioner has approached this Court.

¶3The learned Government Counsel appearing for the respondents would submit that the petitioner's representation dated 25.09.2023 will be disposed of by the 2nd respondent within a period of six weeks.

¶4Heard the learned counsel for the petitioner and the learned Government Counsel for the respondents and also perused the materials available on record.

5.In view of the above, this Court directs the 2nd respondent to consider the petitioner's representation dated 25.09.2023 on its own merits and dispose of the same in accordance with law, within a period of six weeks from the date of receipt of a copy of this order, taking into consideration the fact that the petitioner is in possession of the land and has constructed a residential house thereon.
