Judgment

O R D E R This Writ Petition (Criminal) has been filed quashing the order passed by the 1st respondent in C.No.74/SP/EOW/WZ/SIT/2023, dated 08.07.2023 in so far as it relates to the properties in S.No.5, in the list of properties annexed thereto and consequently, directing the 2nd Respondent to permit the petitioner to encumber, register the documents/deeds in respect of her property.

¶2Heard the learned counsel appearing on either side and perused the materials available on record.

¶3The petitioner is the owner of the property comprised in Survey No.156/1B to an extent of 800 sq.ft situated at Plot No.67, Kannampalayam Village Sulur Taluk, Coimbatore District and the revenue records were also mutated in the name of the petitioner and she has been in continuous possession and enjoyment of the said property. While being so, the 1st respondent herein issued a Letter dated 08.07.2023 stating that a criminal case registered against a third party, M/s. Universal Trading Solution and its directors and the 1st respondent requested the 2nd respondent not to register any further properties in the interest of the case. The 1st respondent in his letter, also mentioned the details of disputed properties, which are including the petitioner's property also.

¶4In pursuant to the registration of FIR in Crime No.3 of 2019 on the file of the Inspector of Police, Coimbatore for the offences punishable under Sections 406, 420 of IPC and Section 3, 4 and 21 of the Banning of Unregulated Deposits Schemes Ordinance subsequently, it was transferred to the file of the 1st respondent. The subject property is identified as it was purchased by the 6th accused in the name of the petitioner. Therefore, the Investigation Agency identified the subject property and instructed the Registering Authority not to permit the petitioner to deal with the subject property by any mode of encumbrance. Now, the subject property is under the process of attachment and as such, this Court finds any infirmity or illegality in the direction issued by the 1st respondent in C.No.74/SP/EOW/WZ/SIT/2023, dated 08.07.2023.

¶5Accordingly, the Writ Petition (Criminal) is dismissed. No costs.
