Judgment
O R D E R This Writ Petition (Criminal) has been filed challenging the order passed by the 4th respondent vide Na.Ka.No.67/Ka.Aa/C5/Ko.Ka.Ni/2025, dated 06.09.2025, thereby rejected the request made by the Petitioner/Sangam seeking permission to operate Mini Lorry during 7.00 am to 10.00 with in the city limit of Corporation of Chennai.
¶2The petitioner is the association for Van Owners. While being so, the 3rd respondent passed Administrative Order banning of heavy vehicle inside the city limits in morning from 7.00 am to 12.00 pm and in the evening at 4.00 pm to 10.00 pm. However, in the meantime, it is very difficult to operate their vehicles for loading and unloading of goods since it consumes considerable time. Therefore, the Public Authorities are not allowed even the light goods vehicles and medium goods vehicles, even though the restrictions are only for heavy vehicles. Therefore, the Petitioner/Sangam submitted a representation dated 18.08.2025 and the same was rejected.
¶3The learned counsel appearing for the petitioner submits that atleast the Mini Lorry may be allowed to enter into the city within limit of Corporation of Chennai.
¶4On perusal of the order impugned in this writ petition dated
06.09.2025 and also on the submission made by the learned counsel appearing for the petitioner, it is revealed that the Government passed order in G.O.Ms.No.793, Home (Tr.V) Department, dated 21.08.2007, the 3rd respondent issued necessary instructions to all the Police Stations, thereby restricted the movement of heavy vehicles within the Corporation limit of Chennai from 7.00 am till 10.00 pm. Therefore, the request made by the petitioner seeking permission to allow their vehicles inside the city limit of Corporation of Chennai was rightly rejected by the 4th respondent.
¶5If at all any grievance, the petitioner ought to have challenged the order passed by the Government in G.O.Ms.No.793, Home (Tr.V) Department, dated 21.08.2007 in accordance with law. Therefore, the respondents 2 to 4 shall have to act in accordance with the order passed by the 1st respondent. Hence, the 4th respondent rightly rejected the request made by the petitioner and this Court finds no infirmity or illegality in the order passed by the 4th respondent vide Na.Ka.No.67/Ka.Aa/C5/Ko.Ka.Ni/2025, dated 06.09.2025.
¶6Accordingly, the Writ Petition (Criminal) is dismissed. No costs. Consequently, the connected miscellaneous petition is closed.
