Judgment

ORDER The petitioner has approached this Court seeking a direction to respondents 1 to 9 to remove the brick wall allegedly put up by respondents 10 and 11 on a public road situated in Survey Nos. 263, 264 and 265, in the Raja Kalvai Canal situated at Begepalli Village, Hosur Taluk, Krishangiri District.

¶2According to the petitioner, the respondents 9 and 10 have constructed a compound wall on the said public road, thereby affecting his right to access and enjoy his property. Respondents 9 and 10 have denied the allegation and contend that the compound wall has been constructed on their patta land and not on the public road.

¶3The seventh respondent has filed a counter affidavit stating that the compound wall was constructed to prevent migrant labourers from causing nuisance. However, the counter affidavit also states that the compound wall was constructed by the twelfth respondent.

¶4In view of the rival contentions and since the dispute involves the location of the compound wall, this Court is of the opinion that the matter should first be examined by the competent authority. Accordingly, the writ Page4 of 6 petition is disposed of with a direction to the third respondent to consider the petitioner's representation dated 02.08.2025 on its own merits and pass appropriate orders in accordance with law, after affording an opportunity of hearing to the petitioner and respondents 9 to 12, within a period of six weeks from the date of receipt of a copy of this order.

¶5Consequently, the connected miscellaneous petition is closed. There shall be no order as to costs. 29-07-2026 Index: Yes/No Speaking/Non-speaking order ak To
