Judgment
O R D E R This Writ Petition (Criminal) has been filed for a direction, directing the respondents 1 and 2 to provide adequate police protection to the petitioner's life, liberty and property bearing Plot No. 8 measuring an extent of 1800 sq.ft. Comprised in Survey No. 205/1C situated at Kozhumanivakkam Village, Kundrathur Taluk, Mangadu, Kancheepuram District from the illegal and unlawful acts of the respondents 3 to 8 and their henchmen.
¶2Heard the learned counsel appearing on either side and perused the materials available on record.
¶3It is seen from the records that there is dispute between the petitioner and respondents 3 to 8 herein in respect of the subject property. In fact, the respondents 3 to 8 already filed a suit in O.S.No.279 of 2017 on the file of the District Munsif Court, Sriperumpudur, as against the petitioner for declaration and injunction. However, the said suit was dismissed for default. So far, they did not take any steps to restore the same. Even then, they are disturbing the peaceful possession and enjoyment of the subject property of the petitioner. Therefore, the petitioner lodged a complaint before the 2nd respondent and the same was closed as the petitioner did not appear for the enquiry. That apart, the petitioner is aged about 80 years.
¶4In view of the above, the 2nd respondent is directed to conduct fresh investigation on the complaints submitted by the petitioner, dated
14.11.2024 and 14.03.2025, after issuance of notice to the petitioner and respondents 3 to 8 herein and pass orders to provide adequate police protection in accordance with law, within a period of four weeks from the date of receipt of copy of this order.
¶5With the above direction, the Writ Petition (Criminal) is disposed of. No costs.
