Judgment

ORDER This Writ Petition (Criminal) has been filed seeking a direction to the respondents 2 to 6 to consider the petitioner's representation dated 12.06.2025.

¶2Heard the learned counsel appearing on either side and perused the materials available on record.

¶3The case of the petitioner is that he owned the properties comprised in RS.No.413, measuring an extent of 0.32 ½ cents and RS.389, measuring an extent of 237 ½ cents, situated at Kesarimangalam Village, Sanniyasipatti Post, Bhavani Taluk, Erode District. According to the petitioner, the respondents 7 and 8 are interfering with the petitioner's peaceful possession and enjoyment of the property. It is further alleged that the petitioner has been prevented from entering into the property by the respondents 7 and 8. Therefore, the petitioner Page3 of 5 submitted a representation seeking appropriate police protection. However, no action has been taken. Hence, the present writ petition.

¶4On instructions, the learned counsel for Government of Tamil Nadu (Criminal Side), appearing for the respondents 1 to 6 submitted that, on the very same allegations, the petitioner had earlier lodged a complaint, which was duly enquired and subsequently, closed. Thereafter, the petitioner has once again submitted another complaint based on the very same set of allegations. Even according to the petitioner, the respondents 7 and 8 are interfering with the peaceful possession and enjoyment of the subject property.

¶5Therefore, the petitioner ought to have approached the Civil Court for appropriate relief as against the respondents 7 and 8. However, if any cognizable offence made against the respondents 7 and 8 in the complaint lodged by the petitioner, the third respondent is directed to proceed with the complaint in accordance with law.

¶6With the above observations and direction, this Writ Petition (Criminal) stands disposed of. No costs. 29-06-2026 Index: Yes/No LPP Page4 of 5 To
