Judgment
ORDER The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 380, 408, 420, 468 of IPC in Crime No.208 of 2025, seeks anticipatory bail.
¶2The allegation against the petitioner is that the petitioner, while working as Principal of the college, has collected a huge amount as fee from the students through his bank account also by way of cash without issuing proper receipts and also not remitted the same into the college bank account and swindled the same. Hence, the case has been registered.
¶3The learned counsel appearing for the petitioner would submit that the petitioner has not personally collected any money, all the payments have been made by the students directly to the bank account of the college and he has not misappropriated any money and is ready to cooperate with the investigation. Therefore, he prayed to grant anticipatory bail to the petitioner.
¶4The learned Government Advocate (Crl.side) appearing for the respondent police reiterated the prosecution case and submitted that they have also recorded the statement of various students and it revealed that a huge Page2 of 5 amount to the extent of Rs.1.91 Crores have been swindled. Hence, he opposed the grant of anticipatory bail to the petitioner.
¶5During the pendency of the anticipatory bail, the petitioner was also directed to appear before the respondent for clarifying his stand and accordingly, he has also regularly appeared, however, it was reported that in the meantime the respondent has also examined almost 12 students and further it revealed that the petitioner has separately received Rs.98.01 lakhs from the above students. Apart from that, he had also involved in various kinds illegal activities naratted in the FIR, and during verification of records, he has repaid Rs.96.86 lakhs and remaining yet to be recovered, the investigation is not concluded.
¶6Considering the above factual aspect, I am of the view that it is still huge amount is to be paid by the petitioner herein and it is a case of misappropriation. Hence, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. 04-02-2026 MPA Page3 of 5 To
