¶2The case of the prosecution is that, based on prior information, the police intercepted a vehicle near VOC Salai, Karaikal, wherein A1 and A2 were found engaged in a heated altercation. Upon enquiry, it is alleged that about

26.095 kgs and 277.949 kgs of ganja were recovered from A1 and A2, and the same was seized. During the investigation, the arrested co-accused confessed that the petitioner/A3 had purchased the commercial quantity of ganja bundles from ganja cultivators in Andhra Pradesh through the assistance of a middleman/co-accused A10, and the same was transported from Andhra Pradesh to Karaikal by utilizing various land carrier vehicles and cars with the assistance of their associates/co-accused A6 to A9. It is also alleged that the petitioner/A3 received money from the Sri Lanka ganja agents through A11, a hawaladar who runs a shop at Burma Bazaar, Chennai, for illegal money transactions, which led to the registration of the FIR. Hence, the present case.

¶3Earlier this Court had dismissed the anticipatory bail petition filed by the petitioner vide order dated 18.11.2025 in Crl.O.P.No.29848 of 2025, with the following observation: " 6. Taking the overall facts into consideration, the contraband seized in this case is of commercial quantity. Hence, Section 37 of the NDPS Act is applicable. Since no grounds have been made Page3 of 4 out to satisfy the twin conditions under Section 37 of the NDPS Act, this Court is not inclined to grant bail to the petitioner.
