ORDER This Petition has been filed to review the order dated 08.10.2025 passed by this Court in W.P. No.37504 of 2025.
¶2Heard the learned counsels appearing on either side. Page3 of 6
¶3The learned counsel for the petitioner submitted that the petitioner's father was allotted the subject property on 26.03.1993 by the first respondent Board and he died in the year 1994 leaving behind the petitioner, her brothers, sisters, including his mother. He further submitted that the entire amount for the subject property was paid by the petitioner to the first respondent, however, the first respondent refused to execute the sale deed in his favour and therefore, he filed the Writ Petition in W.P.37504 of 2025, wherein this Court through its order dated 08.10.2025 had directed the petitioner to furnish "No objection Certificate" of all other legal heirs and the payment arrears receipt to the first respondent and on receipt of all the relevant documents, the first respondent upon verification shall execute the sale deed in respect of the subject property on merits and in accordance with law. Aggrieved by the said directions, the petitioner has come forward with the present Review Petition.
¶4The learned counsel for the review petitioner contended that since the petitioner had paid the entire amount to purchase the subject property though it is allotted in the name of his father, obtaining "No Objection Certificate" [NOC] from the other legal heirs is not necessary and accordingly, he prayed to pass appropriate orders.
¶5The facts of the case is not disputed by the petitioner. The first respondent had allotted the subject property in favour of the petitioner's father Page4 of 6 and he died on 22.10.1994, leaving behind the petitioner and the respondents 2 to 6 herein. Even though the petitioner had paid the entire amount for the subject property, NOC from other legal heirs is necessary, unless providing the same, the sale deed cannot be executed in his favour. Hence, the order dated
08.10.2025 passed by this Court in W.P.No.37504 of 2025, cannot be find fault with. Further, the review application can be maintainable only on the error apparent on the face of record and re-appreciation of the fact is not permissible. Accordingly, the Review Petition is dismissed. There shall be no order as to costs. 27-01-2026 Index: Yes/No Speaking/Non-speaking order DP Page5 of 6 To
