Judgment
ORDER This writ petition has been filed challenging the impugned auction notice dated Nil issued by the fifth respondent.
¶2It is now brought to the notice of this Court by the learned counsel for the petitioner that subsequent to the issuance of impugned auction notice, auction was conducted and shops were allotted to the successful bidder in respect of 38 shops out of 96 shops. She would now submit that the petitioner is not pressing for any relief insofar as 38 shops already allotted pursuant to the Page3 of 4 impugned auction notice. But, the petitioner may be granted liberty to participate in the auction to be conducted by the respondents in the near future in respect of the remaining 58 shops.
¶3This Court is not expressing any opinion on the merits of the representation made by the learned counsel for the petitioner. As and when any auction is conducted in the near future by respondents, it is left open for the petitioner to participate in the said auction by seeking preferential right as the petitioner claims that they are existing lease holders, and it is for the respondents to decide the same, based on the terms and conditions of the auction as to whether the petitioner is eligible to participate in the auction or not.
¶4Since the impugned auction notice has now culminated in allotting of shops to 38 persons, the prayer sought for in this writ petition has become infructuous, and accordingly, this writ petition is disposed of by granting liberty to the petitioner to participate in the auction to be conducted by the respondents in the near future in respect of the remaining 58 shops in the very building complex. No Costs. Consequently, connected writ miscellaneous petitions are closed. 18-03-2026 RKM Page4 of 4
