Judgment
ORDER This petition has been filed to punish the Contemnors/respondents 1 & 3 for wilful disobedience of the order of this Court made in W.P.
(MD) No.15405 of 2025 dated 16.07.2025.
¶2The learned counsel appearing for the petitioner submitted that the respondents had taken the petitioner's land for creating a new channel across it. If the respondents intend to use the petitioner's land for the said purpose, they ought to acquire the land in accordance with law. But no acquisition proceedings have been initiated. He further submitted that a road is also running through the petitioner's land. The petitioner, therefore, alleges wilful disobedience of the Court's order and has filed the present contempt petition.
¶3The learned Additional Advocate General appearing for the respondents submitted that there is no proposal to acquire the petitioner's land, nor do the respondents intend to acquire it in future. It was further submitted that the original channel, situated beyond the petitioner's land, would be used and that the petitioner's land would not be utilised for the said channel. The respondents also gave a specific undertaking that the existing blue-line channel running through the petitioner's property would be closed.
¶4In view of the said undertaking, the respondents are directed to close the existing blue-line channel and open the original channel, which is shown as the green line in the map produced before this Court. This Court has considered only the issue relating to the channel. The question of the road allegedly running through the petitioner's land cannot be adjudicated in a contempt petition. If any road has indeed been formed in the petitioner's land, the petitioner is at liberty to challenge the same in accordance with law.
¶5Accordingly, the contempt petition is closed. The respondents are strictly directed to open the green-line channel and close the existing blue-line channel.
