JUDGMENT The learned counsel who appeared for the appellant made an endorsement in the vakalat reporting 'no instructions'. Therefore, notice was issued to the appellant as early as on 11.09.2009 itself.

¶2However, till date, the appellant has not taken any steps to proceed with the case. Today also, there is no representation for the appellant. In view of the same, the Second Appeal is dismissed for non-prosecution. No costs.
