ORDER This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the first respondent to expedite and dispose of the petitioner's mother's appeal dated 04.01.2025 (received on 06.01.2025), filed for cancellation of the erroneous UDR patta and for issuance of patta in her name, based on the petitioner's representation dated 22.12.2025, within a time frame to be fixed by this Court.
¶2By consent, the Writ Petition is taken up for final disposal at the admission stage itself.
¶3Since no adverse orders are going to be passed against the respondents 2 to 4, notice to the respondents 2 to 4 is hereby dispensed with.
¶4The learned counsel appearing for the petitioner would submit that the petitioner's mother is the lawful owner of the subject property and is entitled to cancellation of the erroneous UDR patta and issuance of patta in her name. An appeal dated 04.01.2025 has been duly filed before the first respondent seeking cancellation of the wrong UDR patta and grant of patta in favour of the petitioner's mother. Despite the filing of the appeal and a subsequent representation dated 22.12.2025, the first respondent has not disposed of the appeal till date. Hence, the present Writ Petition.
¶5The learned Additional Government Pleader appearing for the respondents would submit that the petitioner's appeal will be considered and appropriate orders will be passed on merits and in accordance with law within a time frame to be fixed by this Court.
¶6Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the first respondent to consider the petitioner's mother's appeal dated 04.01.2025, on merits and in accordance with law and pass appropriate orders after providing reasonable opportunity of hearing to the petitioner, the respondents 2 to 4 and any other persons, who may be affected by such decision, within a period of five months from the date of receipt of a copy of this order. There shall be no order as to costs. NCC : Yes / No (K.SURENDER, J.) Index : Yes / No
