ORDER This Civil Revision Petition is filed challenging the order passed by the trial Court dismissing the application filed by the petitioner seeking to record him as legal representative of deceased sole plaintiff.

¶2The instant application has been filed by the petitioner mainly on the ground that he is the testamentary heir of deceased sole plaintiff, namely Kaliammal. However, along with the petition, the Will relied on by the petitioner has not been produced and there is no attempt on the part of the petitioner to prove the Will relied on by him. In such circumstances, the petitioner is not entitled to come on record as legal representatives of deceased sole plaintiff.

¶3It is also seen from the impugned order that, similar application was filed by the petitioner seeking to record him as legal representatives of deceased Kaliammal in I.A.No.2 of 2023 and the said application was opposed by the contesting respondent on the ground that the Will relied on by the petitioner was not a genuine document. The contesting respondent also raised a plea that Kaliammal got some other heirs. The earlier application filed by the petitioner was dismissed as not pressed on

24.02.2025. Thereafter, the petitioner has come up with this application seeking to record him as a legal representative of the deceased Kaliammal. When earlier application was not dismissed with liberty to the petitioner, and he is not entitled to maintain second application. Further, the petitioner failed to produce the Will and the petitioner did not make any attempt to prove the same. In such circumstances, the trial court had no other option but to dismiss the petition.

¶4In such circumstances, I do not find any merits in the present Civil Revision Petition. Accordingly, this Civil Revision Petition stands dismissed. Consequently, connected miscellaneous petition is closed. No costs. NCC : Yes/No
