ORDER This Writ Petition has been filed seeking a Writ of Mandamus directing the respondents 1 and 2 to survey and fix the boundaries of the petitioner's property in S.No.130/1, measuring 8.645 cents, situated at Vandiyur II Bit Village, Madurai East Taluk, Madurai District, pursuant to the representation dated
15.04.2025, and directing the third respondent to afford police protection during the survey, based on the representation dated 22.04.2025, within a time frame to be fixed by this Court.
¶2By consent, the Writ Petition is taken up for final disposal at the admission stage itself.
¶3Since no adverse orders are going to be passed against the fourth respondent, notice to the fourth respondent is hereby dispensed with.
¶4The learned counsel for the petitioner would submit that the petitioner is the lawful owner of the property in Survey No.130/1, measuring 8.645 cents, situated at Vandiyur II Bit Village, Madurai East Taluk, Madurai District. The petitioner submitted a representation dated 15.04.2025 requesting survey and fixation of the boundaries of the said property. Further, by a representation dated
22.04.2025, the petitioner requested adequate police protection during the survey. Despite the same, the respondents have failed to take any action, causing undue delay and prejudice to the petitioner. The petitioner, therefore, seeks a direction to the respondents to conduct the survey, fix the boundaries, and provide protection during the process within a time frame fixed by this Court.
¶5The learned Government Advocate appearing for the respondents 1 and 2 would submit that proper steps would be taken to survey and demarcate the land in accordance with Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act, 1923.
¶6Recording the aforesaid submission, this Court directs the respondents 1 and 2 to consider the petitioner's representation dated 15.04.2025 and demarcate the petitioner's land, after considering the claims of the petitioner and any other rival parties, if any, and to pass orders in accordance with Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act, 1923, within a period of twelve weeks from the date of receipt of a copy of this order. It is needless to state that the revenue officials may seek assistance from the third respondent Police, if Police assistance is required while carrying out such survey. In the event of any rival claims, the parties are at liberty to work out their remedies before the Civil Court.
¶7With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. NCC : Yes / No (K.SURENDER, J.) Index : Yes / No
