ORDER This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the second respondent to dispose of the appeal by the way of considering the petitioner's representation dated 05.08.2025, within a time frame as fixed by this Court.
¶2By consent, the Writ Petition is taken up for final disposal at the admission stage itself.
¶3Since no adverse orders are going to be passed against the fourth respondent, notice to the fourth respondent is hereby dispensed with.
¶4The learned counsel appearing for the petitioner would submit that the subject property is ancestral in nature and has been in the continuous possession and enjoyment of the petitioner's family for several decades. Meanwhile, a certain portion of the property was sold by some third parties by creating fraudulent documents. Aggrieved by the same, the petitioner submitted a representation dated 05.08.2025 before the competent authorities, seeking action to cancel the sale deeds and the mutation of the revenue records. However, despite the lapse of considerable time, no action has been taken on the petitioner's representation. Hence, the present Writ Petition has been filed.
¶5The learned Government Advocate appearing for the respondents 1 to 3 would submit that the petitioner's representation will be considered and appropriate orders will be passed on merits and in accordance with law within a time frame to be fixed by this Court.
¶6Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the second respondent to consider the petitioner's representation dated 05.08.2025, and pass appropriate orders on merits and in accordance with law after providing reasonable opportunity of hearing to the petitioner, the fourth respondent and any other persons, who may be affected by such decision, within a period of sixteen weeks from the date of receipt of a copy of this order. There shall be no order as to costs. NCC : Yes / No (K.SURENDER, J.) Index : Yes / No
