ORDER This petition has been filed to quash the impugned FIR in Crime No. 43 of 2026 on the file of the Inspector of Police, Kovilpatti East Police Station,
¶2The case of the prosecution is that on 10.01.2026, the petitioner and other accused persons are said to have reached the scene of occurrence in 5 four wheelers in order to garland the Maveeran Sundaralinganar Statue and they blocked the road and raised slogans and insulted other communities and caused inconvenience to the public and traffic. Hence, the first information report was registered in Crime No.43 of 2026 for the offences under Sections 3(5), 281, 133, 132, 293, 126(2) of BNS corresponds to Sections 34, 279, 355, 353, 291, 341 of IPC and Section 3 of TNPPDL Act. Hence, the petition.
¶3The learned counsel for the petitioner submitted that the petitioner and other co-accused have participated in the occasion of garlanding Maveeran Sundaralingaranar statue said to have happened on 10.01.2026 and on the same day, the first information report was registered against the unknown persons with respect to the damage caused to the public properties and the petitioner is only the driver of the TATA Sumo Car bearing Reg.No.TN-72-AJ-3429. Hence, he sought the indulgence of this Court to quash the impugned FIR.
¶4The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that though the FIR was registered as against unknown persons, it is clearly mentioned about the registration number of the vehicles in which the hooligans, who have caused damages to the general public as well as public property, were travelling. Further, the petitioner is the driver of one of the vehicles, which is also mentioned in the FIR. Hence, it is obvious that the petitioner had driven the said vehicle, and only on ascertaining the available CCTV footage, he was arrayed as accused No.11. Hence, he prayed for dismissal of the petition.
¶5Heard both sides and perused the materials availabele on record.
¶6A carefule reading of the records, it is seen that the vehicle number of the petitioner ( bearing Reg.No.TN-72-AJ-3429 ) is clearly mentioned in the FIR. Hence, this Court does not find any merit in this petition.
7.Accordingly, this Criminal Original Petition is dismissed. Consequently, the connected miscellaneous petition is closed.
