ORDER Seeking to direct the fourth respondent police not to harass the petitioner under the guise of enquiry, this criminal original petition is filed.
.The learned counsel appearing for the petitioner submitted that on the complaint given by the respondents 5 and 6, the fouth respondent police is subjecting the petitioner to continuous harassment and hence, this petition.
.The learned Government Advocate (crl.side), on instructions, submitted that the fifth respondent gave a complaint against the petitioner alleging that she elopd with one Yasar Arafat along with her minor child and further, it was alleged that she took away some jewels belonged to her parents. During enquiry, she appeared along with Yasar Arafat before the Enquiry Officer and herself admitted that she had willingly gone to the house of Yasar Arafat . The parents of the petitioner requested to return the said jewels. Thereafter, without returning the jewels, the petitioner has filed this petition.
.Per contra, the learned counsel for the petitioner submitted that the petitioner had never ever eloped with anyone and aforesaid Yasar Arafat is none other than the son of fifth respondent's sister and he is taking care of her in difficult situations, when her husband, father and brother have subjected her to physical abuse. It is only at the instance of the petitioner's husband, who is in abroad, her brother and father are pestering her to execute a settlement deed with respect to the property, which stands in her name. Only to escape from the cruel demands of the fifth and sixth respondents, she had willingly gone to take refuge at her uncle's house.
.Heard the learned counsel on either side and carefully perused the materials available on record.
.The nature of the submissions made on either side would make it clear that the dispute involved is nothing, but family dispute. I am of the considered view that the police should not unnecessarily meddle in a family dispute, unless a concrete complaint is received from her husband in person. In a case concerning a missing woman, when the truth has emerged from the victim herself that she has not eloped with anyone and has presently taken refuge with her maternal uncle, the respondent police is directed to close the petition.
.With the above directions, this Criminal Original Petition is disposed of.
