O R D E R This petition has been filed seeking to direct the respondents 1 and 2 to provide police protection to the petitioners at the time of cleaning, leveling, fencing the land earmarked for Public Park, putting up the notice board and laying public road on the land comprised in Town Survey No.3852/1A (Old Town Survey No.3852), Ward No.2, Block No.35C situated at 1st Street Sivanthikulam, Thoothukudi Town, Thoothukudi Village, Thoothukudi District without any disturbance from the 3rd respondent.

¶2The petitioners are land developers who have developed the property after obtaining due approval from the Town Planning Authority, Thoothukudi. In the said approval, a portion of the property was earmarked for use as a public park. The petitioners now seek to put up fencing around the said property. In this regard, the 3rd respondent filed objections before the District Registrar, Registration Department. After considering the objections raised by the 3rd respondent, the authority passed an order dated 01.09.2023. The relevant paragraph of the said order is extracted hereunder: ''kqjhuuhy;

¶3It has been stated that the property claimed by the third respondent is situated at a different location and does not form part of the subject property. Therefore, the petitioners are entitled to fence the same. Accordingly, the second respondent is directed to provide police protection to the petitioners at the time of cleaning, leveling, and fencing the land earmarked for a Public Park, as well as for putting up a notice board and laying a public road on the land comprised in Town Survey No. 3852/1A (Old Town Survey No. 3852), Ward No. 2, Block No. 35C, situated at 1st Street, Sivanthikulam, Thoothukudi Town, Thoothukudi Village, Thoothukudi District. The petitioners shall intimate the date of such activities to the second respondent in advance for the purpose of providing police protection.
