Judgment
O R D E R This Civil Revision Petition has been filed against the fair and decreetal order passed, dated 03/03/2023 in I.A.No.1 of 2019 in HMCMA No.4 of 2016, on the file of the Principal District and Sessions Judge, Virudhunagar District at Srivilliputhur.
2.A petition in I.A.No.1 of 2019 in HMCMA No.4 of 2016 has been filed before the trial Court by the respondents herein, seeking a direction to the petitioner herein, who is the husband of the first respondent herein, to pay a sum of Rs.20,000/- per month as interim monthly maintenance pending disposal of the main petition, a sum of Rs.20,000/- per month towards educational expenses to the second respondent herein and also a sum of Rs.25,000/- towards litigation expenses.
3.The petitioner herein/husband filed a counter denying the averments contained in the petition and stated that the first respondent had voluntarily deserted him along with the child, namely, the second respondent herein, and was living separately. He also denied the avocation stated in the petition and contended that he is a businessman. He would further contend that he has to maintain his parents and therefore, he is not in a position to pay the amount as claimed by the respondents herein.
4.After considering the rival submissions on either side, the trial Court allowed the petition by directing the husband to pay a sum of Rs.20,000/- per month as interim monthly maintenance pending disposal of HMCMA No.4 of 2016, a sum of Rs.25,000/- towards litigation expenses and also a sum of Rs.50,000/- towards educational expenses of the child. Aggrieved by the same, the present revision has been filed by the husband.
5.Heard both sides and perused the materials available on record.
6.While admitting the Civil Revision Petition, this Court passed an order directing the husband to deposit 75% of the arrears of maintenance and also directed him to produce proof to show that the first respondent/wife is working as Post Master. In spite of the above direction, even today, the same contention has been put forth by the petitioner stating that the first respondent is working as a Post Master. However, in order to prove the same, he has not filed any document either before the trial Court or before this Court. Therefore, this Court is of the view that the order passed by the trial Court is proper. It is the duty of the husband to maintain his wife and children and he has to meet the educational expenses of his children. Hence, this Court does not find any reason to interfere with the order passed by the trial Court.
7.In the result, this Civil Revision Petition is dismissed, confirming the impugned order passed by the trial Court. No costs. Consequently, connected Miscellaneous Petition is closed.
