Judgment
ORDER This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the first respondent to dispose of the appeal dated 13.01.2020, within a stipulated time frame to be fixed by this Court.
¶2By consent, the Writ Petition is taken up for final disposal at the admission stage itself.
¶3Since no adverse orders are going to be passed against the fourth respondent, notice to the fourth respondent is hereby dispensed with.
¶4The learned counsel appearing for the petitioner would submit that the subject property originally belonged to Sri Angala Parameswari Temple. Seeking to remove the name of the fourth respondent in respect of the subject property in the SLR, the petitioner has submitted a representation dated 15.12.2023. The second respondent, vide his proceedings dated 16.12.2024, dismissed the application filed by the petitioner. Aggrieved over the same, the petitioner preferred an appeal before the first respondent on 13.01.2025 and the same is still pending without any progress. Hence, the petitioner has been constrained to approach this Court by filing the present writ petition seeking the relief stated supra.
¶5The learned Government Advocate appearing for the respondents 1 to 3 would submit that the petitioner's appeal will be considered and appropriate orders will be passed on merits and in accordance with law within a time frame to be fixed by this Court.
¶6Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the first respondent to consider the petitioner's appeal dated 13.01.2025, and pass appropriate orders on merits and in accordance with law after providing reasonable opportunity of hearing to the petitioner, the fourth respondent any other persons, who may be affected by such decision, within a period of twelve weeks from the date of receipt of a copy of this order. There shall be no order as to costs. NCC : Yes / No (K.SURENDER, J.) Index : Yes / No
