Judgment
ORDER This Writ Petition is filed seeking a Writ of Mandamus directing the respondents 1 and 2 herein to survey the land, situated in Survey Number 883/1C1 with police protection by considering the representation of the petitioner, dated 17.12.2025.
¶2By consent, the Writ Petition is taken up for final disposal at the admission stage itself.
¶3Since no adverse orders are going to be passed against the fifth respondent, notice to the fifth respondent is hereby dispensed with.
¶4The learned counsel for the petitioner would submit that the petitioner is the absolute owner of the subject property. The petitioner submitted a representation dated 17.12.2025 requesting survey and fixation of the boundaries of the said property. Despite the same, the respondents 1 and 2 have failed to take any action, causing undue delay and prejudice to the petitioner. The petitioner, therefore, seeks a direction to the respondents 1 and 2 to conduct the survey and fix the boundaries, within a time frame to be fixed by this Court.
¶5The learned Special Government Pleader appearing for the respondents 1 and 2 would submit that proper steps would be taken to survey and demarcate the land in accordance with Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act, 1923.
¶6Recording the aforesaid submission, this Court directs the respondents 1 and 2 to consider the petitioner's representation dated 17.12.2025 and demarcate the subject property, after considering the claims of the petitioner, the fifth respondent and any other rival parties, if any, and to pass orders in accordance with Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act, 1923, within a period of twelve weeks from the date of receipt of a copy of this order. In the event of any rival claims, the parties are at liberty to work out their remedies before the Civil Court.
¶7With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. NCC : Yes / No (K.SURENDER, J.) Index : Yes / No
