Judgment
ORDER The Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the second respondent herein to dispose the petitioner's appeal dated
12.12.2025 in accordance with law within the time stipulated by this Court in respect of the properties comprised in Survey Nos.412/1 and 412/2, Thiruvelankudi Village, Karaikudi Taluk, Sivagangai District.
¶2By consent, the Writ Petition is taken up for final disposal at the admission stage itself.
¶3The learned counsel for the petitioner submits that the petitioner is the absolute owner of the subject properties, which have been incorrectly entered in the revenue records as 'Government Tharisu'. Previously, the petitioner had requested the cancellation of the assignment Patta issued in favour of one Rajeswari and John Amarnathan in respect of the subject properties. However, the said request was rejected by the third respondent. Aggrieved by the said decision, the petitioner filed an appeal on 12.12.2025 before the second respondent. Since the appeal has been pending without any progress, the petitioner has approached this Court by filing the present writ petition, seeking a speedy disposal of the appeal by the second respondent.
¶4The learned Government Advocate appearing for the respondents would submit that the petitioner's appeal dated 12.12.2025 will be considered and disposed of on merits and in accordance with law within a time frame to be fixed by this Court.
¶5Recording the aforesaid submission and without going into the merits of the matter, this Court directs the second respondent to consider the petitioner's appeal dated 12.12.2025 and dispose of the same on merits and in accordance with law, after affording due opportunity of hearing to all the parties concerned, within a period of sixteen weeks from the date of receipt of a copy of this order.
¶6The Writ Petition stands disposed of with the above direction. No costs. NCC : Yes / No (K.SURENDER, J.) Index : Yes / No
