ORDER This petition has been filed to set aside the order made in I.A.No.2 of 2022 in O.S.No.28 of 2010 on the file of the Additional District Munsif, Tirumangalam, dated 12.10.2022.

.The petitioner is the first defendant before the Additional District Munsif, Thirumangalam, in O.S.No.28 of 2010.

.The suit has been filed by the first respondent for a permanent injunction to restrain the petitioner (first defendant and other defendants) namely, the defendants 6 to 10 from in any manner interfering with the first respondent's ½ share to draw water from the Well in the suit property item No.4 for irrigating the suit item No.1 and 2. In the said suit, the petitioner has filed a written statement together with the counter claim for a direction for specific performance directing the first respondent (Plaintiff) to execute a sale deed in respect of the suit schedule property within a time stipulated and also for a decree for declaring ownership by adverse possession and for a permanent injunction.

.The specific case of the petitioner is that the petitioner is in possession of the property and therefore, the petitioner is entitled to appoint an Advocate Commissioner to give a report. The Trial Court has dismissed the application filed by the petitioner with the following observations:- "6.vjph;kDjhuh;fs;/thjpfs;

.In my view, the Trial Court has come to a just conclusion while rejecting the application for appointment of an Advocate Commissioner. The suit has been filed by the first respondent for permanent injunction. The petitioner, who is the first defendant in the suit has filed I.A.No.2 of 2022 for appointment of an Advocate Commissioner for marking physical future of the property. The prayer in the counter statement itself indicates that the petitioner is seeking relief of specific performance and permanent injunction. If it is the case of the petitioner that the petitioner is in the possession of the property by adverse possession, it is for the petitioner to let in evidence viz., both oral and documentary evidence before the Trial Court. That apart, the suit is of the year 2010. The application for appointment of an Advocate Commissioner was made by the petitioner in the year 2022.

.I find no merits in the present Civil Revision Petition to interfere with the impugned order. Hence, this petition is liable to be dismissed and accordingly, dismissed. No costs. Consequently, the connected miscellaneous petition is closed.
