Judgment
ORDER The present writ petition has been filed challenging the order passed by the first respondent herein wherein the request of the petitioner for payment of compensation for putting up a tower line in the property has been rejected.
¶2According to the learned Counsel appearing for the writ petitioner, a portion of their property was purchased by the TANGEDCO for putting up a tower line. However, while putting up the tower line, without the knowledge of the petitioner's temple, they have extended the tower line to the area which was not covered under the sale deed. Therefore, they made a request for payment of compensation. However, the said request has been rejected on the ground that the tower line has been erected only in the property purchased by the temple. Hence, the present writ petition.
¶3The facts narrated above will clearly indicate that there is a dispute whether the tower line has been put up by the TANGEDCO officials in the property purchased by them or outside the property. Therefore, the order impugned in the writ petition is set aside the matter is remitted back to the file of the first respondent. The first respondent is directed to conduct a survey with the help of the Town Surveyor in the presence of the officials of the petitioner's Temple in order to find out whether the constructions have been put up in the land purchased by the TANGEDCO or outside the said area. After verification, in case if it is found that the constructions have gone beyond the area covered in the sale deed, the respondent officials are directed to proceed in accordance with law.
¶4With the above said observations, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petitions are also closed.
