WP(MD) 4487/2026

Judgment

O R D E R This Writ Petition is filed seeking a direction to the 3rd respondent to register the "Thahar Nagar Muslim Jamat" situated at Karumandapam, Trichy as a waqf under the Tamil Nadu Waqf Board in view of the order passed in W.P(MD)No.1829 of 2024 by this Court dated 06.11.2024 within a stipulate time.

¶2By consent, this Writ Petition is taken up for final disposal at the admission stage itself. Since no adverse order is going to be passed against the third respondent, notice to him is dispensed with.

¶3The learned counsel appearing for the petitioner would submit that though this Court by order dated 06.11.2026, directed the respondents to pass appropriate orders with regard to the registration of "Thahar Nagar Muslim Jamat", till date no order has been passed to register the same. Hence, the petitioner has filed this Writ Petition.

¶4The learned counsel appearing for respondents 1 and 2 would submit that, since the first respondent Board has been suspended, they are not in a position to pass any order as directed by this Court. It is further submitted that appropriate orders will be passed once the first respondent Board is reconstituted.

¶5In view of the above, this Court, without going into the merits of the matter, directs the first respondent to consider the petitioner's request for registration of "Thahar Nagar Muslim Jamat" as a wakf, within a period of eight weeks from the date of reconstitution of the first respondent Board.

¶6With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
