Judgment

ORDER This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first respondent to direct the second respondent to cancel the Patta in Patta No.5488 of Survey No.551/1, which stands in the name of the fourth respondent for the land measuring an extent of 1 Acre and 1 Cent, situated at T.Chettiarpatti Village, Melur Taluk, Madurai District, based on the petitioner's petition in Na.Ka.No.9429/2025/A1, dated 22.12.2025.

¶2By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

¶3Since no adverse orders are going to be passed against the fourth respondent, notice to the fourth respondent is hereby dispensed with.

¶4The learned counsel for the petitioner submits that the subject property originally belonged to the petitioner's mother and after the demise of her mother, the said property was devolved upon the legal heirs and they are in peacefule possession of the property. While so, the revenue officials without conducting a proper enquiry and without issuing any notice to the petitioner, tranferred the Patta in respect of the subject property in the name of the fourth respondent. Therefore, the petitioner and her elder sister made a petition dated 22.12.2025, seeking cancellation of the illegally issued Patta. Despite receipt of the petition dated 22.12.2025 along with supporting documents, the official respondents have failed to conduct any enquiry or pass appropriate orders. Hence, the petitioner has been constrained to approach this Court seeking the relief stated supra.

¶5The learned Government Advocate appearing for the respondents 1 to 3 submits that the second respondent / Revenue Divisional Officer, Narasingampatti, Melur Taluk, Madurai District, is the competent authority to look into the grievance raised by the petitioner and that the petitioner's petition dated 22.12.2025 will be considered and disposed of on merits and in accordance with law within a time frame to be fixed by this Court.

¶6Recording the aforesaid submission and without going into the merits of the matter, this Court directs the second respondent to consider the petitioner's petition dated 22.12.2025 and dispose of the same on merits and in accordance with law, after affording due opportunity of hearing to all the necessary parties concerned, within a period of eight weeks from the date of receipt of a copy of this order.

¶7The Writ Petition stands disposed of with the above direction. No costs. NCC : Yes / No (K.SURENDER, J.) Index : Yes / No
