ORDER The present civil revision petition has been filed against the fair and decreetal order, dated 05.01.2023 passed in I.A.No.3 of 2022 in O.S.No.69 of 2014 on the file of the District Munsif Court, Keeranur.
¶2The petitioner is the first defendant in O.S.No.69 of 2014 before the District Munsif Court, Keeranur. The petitioner was set ex parte on
21.07.2014. It is submitted that the petitioner has filed an application under Order 9 Rule 7 of C.P.C., on 27.10.2022 to set aside the order setting the petitioner ex parte on 21.07.2014. It is submitted that the District Munsif Court, Keeranur has committed an error in rejecting an application to set aside the order setting the petitioner ex parte on
21.07.2014. The relevant portion of the order reads as under: "gpur;ridf;fhd jPh;T:

¶3The facts on record indicate that the petitioner has been negligent in not entering appearance after the summons were served. The fact remains that the petitioner is merely the person, who had power of attorney in his favour, which is said to be executed by the third defendant on the strength of which the petitioner had executed a sale agreement dated 07.12.2009.
¶4Prima facie, it appears that the suit itself was beyond the limitation. There is no scope for enquiry. The fact remains that the third defendant is merely a proper party to the suit, who has executed a sale deed in favour of the fourth defendant on 01.03.2011. The fourth defendant in the suit has executed a further sale deed in respect of the property of the second respondent/second defendant
¶5In my view, even if the petitioner had sufficient reasons to explain for condoning the delay, the fact remains that the petitioner is merely an agent power of attorney holder. Therefore, no interference is called for against the impugned order. The decision of this Court cited by the learned counsel for the petitioner in the case of Rajasekar Vs Govindammal (late) reported in 2020-4-LW-481 is no relevance to the facts of the case inasmuch as the affidavit filed by the petitioner for condoning the delay is enormous and no prejudice will be caused to the petitioner as the petitioner is not owner of the property.
¶6In the light of the above, the present Civil Revision Petition is liable to be dismissed and accordingly, dismissed. No costs. Consequently, connected miscellaneous petition is closed.
