Judgment
ORDER This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first respondent to consider the petitioner's representation dated
05.01.2026 for issuance of a Natham house-site patta in her favour in respect of the house situated in Survey No.517/2 at Andakkulam Village, Kulathur Taluk, Pudukkottai District, within a time frame to be fixed by this Court.
¶2By consent, the Writ Petition is taken up for final disposal at the admission stage itself.
¶3The learned counsel for the petitioner submitted that the petitioner is in continuous possession and enjoyment of the subject property. It is further submitted that, in order to regularise her occupation and obtain a Natham house-site patta in her favour, the petitioner submitted a representation dated 05.01.2026 before the first respondent. However, till date, the said representation has not been considered and no orders have been passed. Hence, the petitioner has approached this Court seeking a direction to the first respondent to consider and dispose of the said representation within a time frame to be fixed by this Court.
¶4The learned Additional Government Pleader appearing for the respondents submitted that the land in respect of which the petitioner has sought patta is classified as a cart track. Therefore, the question of granting patta does not arise. The learned Additional Government Pleader further submitted that based on the order passed by the Division Bench of this Court in W.P.(MD)No. 28728 of 2024, dated 02.12.2024 [Annadurai vs. The District Collector, Pudukkottai District and others], the petitioner has been issued with a Form-I notice and that she may raise her objections, which will be considered, and appropriate orders will be passed in accordance with law.
¶5Recording the above submissions and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the petitioner to raise her objections. Upon receipt of such objections, the first respondent shall consider the same and pass appropriate orders in accordance with law, within a period of sixteen (16) weeks from the date of receipt of such objections. There shall be no order as to costs. NCC : Yes / No (K.SURENDER, J.) Index : Yes / No
