Judgment
ORDER This Writ Petition is filed seeking a Writ of Mandamus directing the respondents 1 and 2 to survey and demarcate the petitioner's property comprised in Survey No.280/8A1A1 to an extent of 11.5 Cents, situated at Boodhamangalam Village, Melur Taluk, Madurai District and also directing the third respondent to provide adequate police protection at the time of survey and demarcate the petitioner's property, within the time frame that may be fixed by this Court.
¶2By consent, the Writ Petition is taken up for final disposal at the admission stage itself.
¶3Since no adverse orders are going to be passed against the fourth respondent, notice to the fourth respondent is hereby dispensed with.
¶4The learned counsel for the petitioner would submit that the petitioner is the absolute owner of the subject property and is in possession and enjoyment thereof. With a view to properly identifying the boundaries and avoiding future disputes, the petitioner submitted a representation dated 16.12.2025 before the competent revenue authorities seeking survey and demarcation of the said land. Pursuant to the said representation, a notice dated 08.01.2026 was issued fixing
05.02.2026 for conducting survey. However, when the officials attempted to conduct survey, certain adjoining land owners unlawfully obstructed the same. Therefore, the survey could not be completed. Hence, the petitioner has been constrained to approach this Court by filing the present Writ Petition for the relief stated supra.
¶5The learned Government Advocate appearing for the respondents 1 and 2 would submit that proper steps would be taken to survey and demarcate the land in accordance with Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act, 1923.
¶6Recording the aforesaid submission, this Court directs the respondents 1 and 2 to consider the petitioner's representation dated 16.12.2025 and demarcate the subject property, after considering the claims of the petitioner, the fourth respondent and any other rival parties, if any, and to pass orders in accordance with Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act, 1923, within a period of twelve weeks from the date of receipt of a copy of this order. It is needless to state that the revenue officials may seek assistance from the third respondent Police, if Police assistance is required while carrying out such survey. In the event of any rival claims, the parties are at liberty to work out their remedies before the Civil Court.
¶7With the above direction, this Writ Petition is disposed of. There shall be no order as to costs. NCC : Yes / No (K.SURENDER, J.) Index : Yes / No
