Karthikkumar v. The Executive Engineer

O R D E R The present Writ Petition has been filed seeking to quash the communication issued by the fourth respondent to the petitioner, wherein, the petitioner has been called upon to produce his property documents to establish how he claims title over the property.

¶2It could be seen from the records that the fifth respondent had made a payment to the TANGEDCO for relocating electrical pole and L.T Service lines. When the TANGEDCO officials made an attempt to shift the pole and the electrical service lines, an objection was raised by the writ petitioner contending that he has got a right over the property, in which, the pole and the lines are proposed to be erected. Therefore, TANGEDCO officials have called upon the petitioner to produce the relevant documents. This request made by the TANGEDCO officials cannot be found fault with.

¶3In view of the above, the petitioner is directed to produce the documents to establish his right over the property because he is disputing the relocation of the LT service lines and the electrical poles. On production of the documents, the TANGEDCO officials are directed to consider it and proceed in accordance with law.

¶4With the above said observation, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently connected Miscellaneous Petition stands closed.
