Judgment

ORDER The writ petitioner filed this Writ Petition seeking for issuance of a Writ of Certiorarified Mandamus, to quash the impugned Police Verification report in P.V.R.No.S5942600084229 and consequently to direct the respondents No.1 and 2 to remove the petitioner's name from the crime record bureau and to issue a clear police verification certificate.

¶2Now the grievance of the petitioner is that he was selected in the Indian Army Force and he has to report before the concerned authority on or before 09.03.2026.

¶3The learned Government Advocate (Crl. Side) would submit that the petitioner was arrayed as an accused in crime No.79 of 2023 on the file of the fourth respondent/Koodakovil Police Station for the offences under Sections 147, 148, 294(b), 323, 324, 336, 341, 355, 307 and 506(ii) of IPC. The above said complaint was investigated. During the course, finding that the petitioner is not involved in the above said occurrence, his name was deleted and the deletion report was submitted before that learned Chief Judicial Magistrate, Thirumangalam.

¶4Based upon the above said investigation process, the petitioner approached the official respondent seeking the above said certificate. Even though the above said deletion report is filed and Final Report was filed, but still in the Tamil Nadu Police Verification Report, which appears in the website (I.e) www.eservices.tnpolice.gov.in, the name of the petitioner shows as an accused in Crime No.79 of 2023 and because of the above said appearance in the online portal, the concerned authority has not accepted the certificate issued by the second respondent herein.

¶5The learned Government Advocate (Crl. Side) would submit that Final Report has been filed, so far notice is not issued to the defacto complainant with regard to the deletion of name of the petitioner from the Crime No.79 of 2023.

¶6But it is a separate process to be initiated by the defacto complainant.

¶7But it appears that as on date, the name of the petitioner is deleted from the above said crime No.79 of 2023. So, in the online portal, it must be formally corrected. Let the above said process be completed on or before 03.03.2026 by the first respondent.

¶8With the above direction and liberty, this writ petition stands disposed of. No costs.
