Judgment

ORDER The present petition has been filed by A9 and A11 in C.C.No.6 of 2024 on the file of the learned Special Court TNPID Act Cases, Madurai, seeking to quash the charge sheet, wherein, they are alleged to have committed offences under Sections 406, 420 and 120(b) of IPC and Section 5 of Tamil Nadu Protection of Interests of Depositors (TNPID) Act, 1997.

¶2According to the learned Senior Counsel appearing for the petitioners, the petitioners have settled the entire amount in favour of all the depositors. However, since the other accused persons are absconding, they are not able to close the criminal proceedings.

¶3Per contra, the learned Counsel for State of TN (Crl.Side) appearing for the first respondent submitted that out of 96 list witnessess, 95 of them have already been examined. Only the Investigating Officer remains to be examined. In such circumstances, at the belated stage, the petition seeking to quash the charge sheet cannot be entertained.

¶4Heard the learned Senior Counsel appearing for the petitioners, the learned Counsel for State of TN (Crl.Side) appearing for the first respondent and perused the materials available on record.

¶5It could be seen from the records that the trial has begun in April 2025 and it is in the advance stage. All the list witnessess except the Investigating Officer have been examined. In such circumstances, the question of entertaining the petition seeking to quash the charge sheet at the advance stage of trial does not arise.

¶6In view of the above said facts, there shall be a direction to the learned Special Court TNPID Act Cases, Madurai, to dispose of the case in C.C.No.6 of 2024 on or before 20.07.2026.

¶7With the above said observation, this Criminal Original Petition is disposed of. Consequently connected Miscellaneous Petitions are closed.
