ORDER

C.R.P(MD)No.1030 of 2023 has been filed against the fair and decreetal order passed in I.A.No.7 of 2022 in O.S.No.237 of 2015, dated

06.12.2012 on the file of the Principal Sub Court, Tirunelveli.

¶2C.R.P(MD)No.1031 of 2023 has been filed against the fair and decreetal order passed in I.A.No.8 of 2022 in O.S.No.237 of 2015, dated

06.12.2012 on the file of the Principal Sub Court, Tirunelveli.

¶3The petitioner is the plaintiff in O.S.No.237 of 2016 before the Principal Sub Court, Tirunelveli. The said suit has been filed by the petitioner for partition of the suit schedule property.

¶4After the trial was complete, the petitioner herein filed I.A.Nos. 7 and 8 of 2022 for re-opening the evidence and for appointment of an Advocate Commissioner to take blood sample of the petitioner for comparison with the blood sample of the third respondent/third defendant, namely, Maragatha Murugan, who according to the petitioner is not the son of the petitioner's father. It is submitted that the third respondent/third defendant was not sired by her father and that due to the old age of the petitioner's father, the third respondent/third defendant's mother, who was working as a domestic helper took advantage of the proximity.

¶5The learned counsel for the petitioner submits that the petitioner had earlier filed I.A.No.3 of 2020 to amend the plaint, which came to be dismissed on 17.11.2021. The learned counsel for the petitioner submits that the attempts have been made to set aside the order dismissing the application for amending the plaint vide order, dated 17.11.2021.

¶6I have considered the arguments advanced by the learned counsel for the petitioner.

¶7A reading of the plaint filed in O.S.No.237 of 2015 indicates that the petitioner has not questioned the factum that the third respondent is her half brother. In fact, the petitioner has made the third defendant as a party to the suit as otherwise it would not have been necessary for the petitioner even implead the third defendant as a defendant in the suit. The application has been filed belatedly. Therefore, the Principal Sub Court, Tirunelveli, has dismissed the application filed by the petitioner with the following observations: "8. ,Ujug;G thjk; kw;Wk; Mtzq;fspd; mbg;gilapy; ghh;itapLk; nghOJ mry; tof;fhdJ ghf gphptpid kw;Wk; Mtzq;fis nry;yhJ vd tpsk;Gif nra;a

¶8I do not find any reason to interfere with the order passed in I.A.No.7 of 2022. The application was filed when the case was listed for argument after recording of evidence. Consequently, C.R.P(MD)No.1031 of 2023 against the order passed in I.A.No.8 of 2022 is also not maintainable.

¶9Therefore, the present Civil Revision Petitions stand dismissed with the above observations. No costs. Consequently, connected miscellaneous petitions are closed.
