Judgment
O R D E R This Writ Petition has been filed in the nature of mandamus seeking direction to the first respondent to rectify the entries made in the Encumbrance Certificate relating to Document Nos.766/2011, 767/2011 and 770/2011 which had been registered in the office of the Sub Registrar, Shenkottai in Tenkasi District / third respondent herein on 04.05.2011.
¶2The petitioner, had purchased 45 Acres and 69.50 Cents at Shenkottai Melur Village, Shenkottai Taluk, Tenkasi District. The lands were in S.Nos.1070/1A2, 1070/7A2 and 1070/7A3. In the sale deeds, however, further survey numbers were included, namely, S.No.1070/2, 1070/3, 1070/4, 1070/5 and 1070/6. These lands were not purchased by the petitioner, but they were reflected in the schedule in the sale deeds. Therefore, since entries were made in the Encumbrance Certificate a complaint was given by those land owners that the said entries sale deeds which have been registered as Document Nos.766/2011, 767/2011 and 770/2011 are fraudulent entries. Aggrieved by those particular entries made in the Encumbrance Certificate, the petitioner approached the first respondent. Final orders were passed on 04.08.2022. The affidavits were obtained from the adjacent land owners.
¶3The petitioner also claims right only to the lands in S.Nos. 1070/1A2, 1070/7A2 and 1070/7A3, totally measuring 45 Acres 69.50 Cents. In the order of the first respondent, he had finally concluded as follows: W.P.(MD)No.5950oofo2023 "br';nfhl;il tUtha; Mat; hsuhy; br';nfhl;il tUtha; tll; hr;rpau; mtu;fSf;F vGjgg; ll; fojk; vz;/1685-10 ehs;/ 02/03/2010y; br';nfhl;il nkY}u; fpuhk g[y vz;fs;/1070-1A1. 1C. 7A1. 7A3okw;Wk; 1070-7A2.oMfpa gy[ vz;fspYkhf bkhj;jk;

¶4A careful reading of the aforesaid order shows that he had come to a definite conclusion that the claim that the documents have been fraudulently entered in the Encumbrance Certificate, is not correct. However, he had further stated that if ever any of the parties claim title or assert title with respect to aforementioned lands in the stated survey numbers, then, they must go to the Civil Court.
¶5The relief sought in the Writ Petition is very narrow. A declaration of right is not sought in the Writ Petition but rather rectification of that particular entry in the Encumbrance Certificate consequent to the order, dated 04.08.2022 by the first respondent.
¶6That particular direction should also have been given by the first respondent as a consequential order and such direction should have been given to the third respondent / Sub Registrar to carry out necessary correction in the register maintained in the office of the third respondent.
¶7A direction, is, therefore issued that the first respondent has to examine the said order passed by him on 04.08.2022 and issue one further additional direction, namely, that, consequent to his finding that it was not a fraudulent transaction, to further direct the third respondent to cancel that particular entry in the Encumbrance Certificate and in the registers maintained in the office of the third respondent.
¶8The matter has to be remitted back to the first respondent for this particular purpose. Though the order is remitted back to the first respondent to clarify about the necessity to correct the entry in the Encumbrance Certificate, the petitioner, may, give a fresh representation along with the order dated 04.08.2022 and a copy of this order to the first respondent, who may incorporate that particular additional direction in the already passed order dated 04.08.2022. The petitioner may give a fresh representation within a period of three weeks from the date of receipt of a copy of this order and thereafter, within a period of eight weeks from that date, the first respondent may pass necessary consequential order.
¶9This Writ Petition stands disposed of. There shall be no order as to costs.
