Judgment
ORDER This petition has been filed seeking direction to the respondents 1 and 2 not to harass the Petitioner and his family members under the guise of enquiry.
¶2Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondents.
¶3Since it is a matrimonial dispute between the husband and wife, for exploring the possibility of settlement, notice was issued to the 3rd respondent. Even though the notice was served on the third respondent no one has appeared.
¶4Perusal of the CD file it is seen that during the course of enquiry, both sides appeared and the husband, who is the petitioner herein gave an undertaking that he will not cause any trouble to his wife, similarly, he also returned the Two Wheeler and 10 sovereigns of gold jewels within a month. On the basis of the understanding reached between the parties, the above said complaint was closed.
¶5Since already some understanding is reached between the parties the petitioner must comply the undertaking. The learned counsel appearing for the petitioner submitted that the petitioner is also ready to comply the above said undertaking and hence, nothing survives for adjudication in this petition.
¶6Accordingly, this Criminal Original Petition is dismissed as infructuous.
