Judgment

O R D E R This writ petition has been filed seeking a writ of mandamus directing the respondents 2 and 3 to pay arrears of salary to the petitioner from 01.01.2025 till date and also to pay him future pay without any failure in the light of the proceedings bearing Na.Ka.No.24649/2025/C.F.C13, dated

15.04.2025, issued by the first respondent.

¶2The petitioner herein, who was appointed as a Computer Assistant in Mudukankulam Village Panchayat, vide Resolution No.31 of 2024, joined duty on 01.07.2024 and thereafter, the petitioner was not paid salary for the period he worked and therefore, he approached this Court by filing a writ petition in W.P.(MD) No.27213 of 2024 and during the pendency of the said writ petition, the petitioner was paid salary and accordingly, the said writ petition came to be closed by this Court vide order dated 17.12.2024. It was thereafter, the petitioner filed a contempt petition in Cont.P.(MD) No.54 of 2025 before this Court alleging violation of the said order dated 17.12.2024 passed in the said writ petition. But, the said contempt petition was closed by this Court as the said order was already complied with by the respondents. Once again, the petitioner has approached this Court by filing the present writ petition seeking the relief of payment of salary, on the ground that the petitioner has been working continuously from the month of January, 2025 onwards, but, he is not paid salary.

¶3In response to the notice issued by this Court, the respondents filed their counter-affidavit contending that the very appointment of the petitioner as Computer Assistant was under a Scheme and the same can be continued only during the subsistence of the said Scheme and the petitioner has not been working from the month of January, 2025 and therefore, the question of payment of salary does not arise.

¶4The respondents filed their counter-affidavit as early as on

09.04.2026. But, no rejoinder has been filed by the petitioner contradicting the averments made in the said counter-affidavit nor there is any material placed before this Court to show that the petitioner has been in fact working from the month of January, 2025. In the absence of any material to show that the petitioner has been working from the month of January, 2025 onwards, this Court has no other option except to take into consideration the averments made in the counter-affidavit filed by the respondents.

¶5Accordingly, this writ petition is dismissed. No costs.
