Judgment
O R D E R This contempt petition has been filed by the petitioner complaining willful disobedience of the order dated 04.11.2025, in W.P.(MD) No.31256 of 2025, passed by this Court.
¶2The said writ petition was disposed of at the admission stage by taking into consideration the submissions made by the learned counsel for the second respondent therein stating that they would follow the guidelines issued by the National Medical Commission while filling up the post of Assistant Professor and further directing the second respondent therein to follow the guidelines issued by the National Medical Commission while filling up the post of Assistant Professor.
¶3This contempt petition has been filed contending that the respondents have not followed the guidelines issued by the National Medical Commission in the Notification dated 30.06.2025 while filling up the post of Assistant Professor.
¶4In response to the notice issued by this Court, the respondents 1 & 2 herein have filed their counter-affidavit contending that they have strictly followed the guidelines issued by the National Medical Commission.
¶5From the perusal of the affidavit filed in support of this contempt petition, it is seen that there is no specific allegation or instance of the alleged violation of the guidelines issued by the National Medical Commission. Though learned counsel for the petitioner, across the Bar, contended that ineligible candidates have been appointed to the post of Assistant Professor, there is no material placed before this Court. On the other hand, the respondents 1 & 2, in Paragraph No.6 of their counter-affidavit, have contended that after conducting transfer counselling, there is no vacancy for considering the cases of the eligible persons for appointment to the post of Assistant Professor. If that be the case, this contempt petition cannot be entertained basin upon the vague allegations.
¶6Accordingly, this contempt petition is dismissed leaving it open to the petitioner to file a fresh contempt petition, in case if he finds any violation of the orders passed by this Court.
