Judgment

ORDER (Order of the Court was made by N.SATHISH KUMAR, J.) The petitioner has filed the present Writ Petition seeking a direction to respondents 1 to 5 to take steps to remove the unauthorized pig farm at Kambilinayankanpatti Village, Dindigul District, based on the representation dated 22.01.2026.

2.By consent of both parties, this Writ Petition is taken up for final disposal at the admission stage itself.

3.Mr.P.T.Thiraviam, learned Government Advocate, accepts notice for the official respondents. Considering the limited relief sought by the petitioner, notice to the respondents 6 and 7 is dispensed with.

4.It is the contention of the petitioner that the respondents 6 and 7 have established a pig farm at Kambilinayakanpatti Village and are rearing more than 500 pigs without any license. The uncontrolled rearing of pigs is causing disturbance, serious health hazards, and nuisance to the general public. The pigs are straying in open areas, causing pollution and damaging agricultural lands in the village. The petitioner, along with other villagers, submitted a representation to the respondents 1 to 5 on 22.01.2026, requesting immediate action to remove the pig farm. However, no action has been taken so far. The officials are duty-bound to act under the Tamil Nadu Panchayats (Licensing of Pigs and Destruction of Unlicensed or Infected Pigs) Rules, 1996. Since no action has been taken, the petitioner has filed the present Writ Petition.

5.The learned Government Advocate appearing for respondents 1 to 5, on instructions, submitted that respondents 6 and 7 have established a pig farm in their property, which was registered as Document No.898 of 2016, dated 13.04.2016. He further submitted that the officials would inspect the site and take appropriate action in accordance with the relevant provisions of law.

6.Considering the submissions made on either side, this Court directs the first respondent to ascertain whether there has been any violation in establishing the pig farm and to consider the petitioner's representation dated 22.01.2026. The first respondent shall pass appropriate orders on merits and in accordance with law, after affording due opportunity of personal hearing to the petitioner, respondents 6 and 7, and any other interested parties. Such exercise shall be completed within a period of three months from the date of receipt of a copy of this order.

7.With the above directions, this Writ Petition is disposed of. No costs. [N.S.K.,J.] [M.J.R.,J.]
