ORDER The present Civil Revision Petition has been filed against the fair and decreetal order passed in I.A.No.5 of 2022 in O.S.No.268 of 2008 dated 27.01.2023 on the file of the District Munsif, Lalgudi.

¶2The petitioner is the plaintiff in O.S.No.268 of 2008 before the District Munsif Court, Lalgudi. The said suit was filed against the respondents/defendants for the following relief: "i) For mandatory injunction directing the defendants to remove the offending constructions put up by the defendants 1 and 2, 3 and 4 in the suit common pathway 'ABCD' within a time fixed by the Hon'ble Court, failing which to have it done through process of Court;

ii) For a permanent injunction restraining the defendants 1 to 4 from any way blocking the suit common pathway 'ABCD' or interfering with the plaintiff's peaceful enjoyment of free ingress and egress through the pathway, in any manner whatsoever;

iii) To award costs of the suit; and

iv) To grant such further or other reliefs as this Hon'ble Court may deem fit and proper in the nature and circumstances of the case, and thus render justice."

¶3After the trial was over and at the time of commencement of the argument, the petitioner presented I.A.No.5 of 2022 on 17.11.2022 under Order 76 of the Civil Rules of Practice. By the impugned order, the District Munsif Court, Lalgudi has dismissed the above application: ,Ujug;Gk; Nfl;fg;gl;lJ.

¶4The suit is of the year 2008 and the trial was complete long before. The application that has been filed on 17.11.2022 clearly intended to delay the disposal of the suit. I do not find any reason to interfere with the impugned order.

¶5The present Civil Revision Petition stands dismissed with the above observations. No costs. Consequently, connected miscellaneous petition is closed.
