Judgment

ORDER (Order of the Court was made by R.SUBRAMANIAN, J.) The prayer in the writ petition is for issuance of a Writ of Mandamus, directing the respondents herein to extend the time for payment of the balance sale consideration of the auction sale amount in respect of the house property on the basis of auction sale conducted on 21.11.2022 by the 2nd respondent bank.

¶2The sale was held on 21.11.2022. The petitioner paid 25% of the bid amount. The balance is payable within 15 days from the date of sale or within such extended period not exceeding three months. The petitioner did not pay the balance amount despite the Bank having extended the time till the expiry of the three months period i.e., on 20th of February 2023. Now that the three months period has also lapsed, neither the Bank nor this Court have the power to extend the time.

¶3Hence, the Writ Petition fails and it is accordingly dismissed. No costs. (R.SUBRAMANIAN, J.) & (L.VICTORIA GOWRI, J.)
