Selvaraj v. The District Collector

O R D E R This Writ Petition has been filed in the nature of a Mandamus seeking a direction to the respondents to conduct survey of the natham land in Natham S.No.910/32 at Aathinathapuram Village, Eral Taluk, Tuticorin District and demarcate the boundary. The petitioner had given an application on 23.12.2022.

2.Heard Mr.T.Indrachithu, learned Counsel for the petitioner and Mr.N.Muthu Vijayan, learned Special Government Pleader for the respondents.

3.In the affidavit filed in support of this Writ Petition, it had been stated that the aforementioned lands are the ancestral lands of the petitioner and thereafter, there was an oral partition dividing the properties. The petitioner was allotted 1/4 share of 3.22 ares in Natham S.No.910/32. A joint Natham Nilavari Thitta Thooya Chitta in Patta No. 161 was also issued. The petitioner seeks to construct a house there. Therefore, he filed a representation to survey the land.

4.Taking into consideration the facts as stated above, a direction is issued to the respondents, particularly, second, third and fourth respondents to issue notice to the petitioner and also all his brothers and sisters and thereafter, proceed to survey the land, if they are no objections. The entire exercise may be completed within a period of eight weeks from the date of receipt of a copy of this order.

5.The Writ Petition stands disposed of. No costs.
