ORDER This Criminal Original Petition has been filed to transfer the investigation of Crime No.203 of 2022 pending on the file of the 2nd respondent and entrust the same to the file of the 3rd respondent or any other specialized agency.
.Seeking transfer of investigation from the second respondent to some other officer, this criminal original petition has been filed. The petitioner is the accused in Crime NO.203 of 2022 for the offence punishable under Section 380 of IPC. The grievance of the petitioner is that the above said jewels are handed over to this petitioner by the fourth respondent, who is his Master. The petitioner was working as house maid in the house of the fourth respondent. After coming out of the bail, she made representation for transfer of investigation as if she experienced some sort of bias attitude by the second respondent.
.The learned Additional Public Prosecutor would submit that investigation is over and remaining jewel has not been recovered so far. According to him, out of 17 soverigns of jewels 10 soverings of jewels was pledged with Muthoot finance company. It has to be recovered. Remaining 7 soverigns of jewels is also yet to be recovered.
.Perusal of CD file shows that because of the non compliance of the condition that was imposed upon the petitioner, steps has been taken to cancel the bail. It is also stated that the remaining jewels was not recovered so far.
.Considering the above said development, I find no reason to transfer the investigation from the hands of the second respondent to some other officer. The petitioner shall cooperate with the second respondent to complete the process of investigation. This petition deserves to be dismissed.
.Accordingly, this criminal original petition is dismissed.
