Irulayi v. The Inspector of Police

ORDER This Criminal Original Petition has been filed, invoking Section 482 Cr.P.C., seeking orders directing the respondent to file final report on the basis of the FIR in Crime No.62 of 2022 dated 23.05.2022.

¶2When the matter is taken up for hearing today, the learned Additional Public Prosecutor appearing for the respondent would submit that the respondent, after completing the investigation in Crime No.62 of 2022, has laid the final report dated as 'Mistake of Fact' before the concerned Court.

¶3At this juncture, the learned counsel appearing for the petitioner would submit that RCS notice was not served on the petitioner/defacto complainant either by the respondent police or from the concerned Court.

¶4Recording the submissions made on either sides, the respondent is directed to serve RCS notice on the petitioner/defacto complainant and the petitioner is at liberty to file a protest petition, if so advised before the jurisdictional Court.

¶5With the above direction, this Criminal Original Petition stands disposed of.
