Judgment

ORDER This Criminal Original Petition has been filed to direct the respondent/ Inspector of Police to file the charge sheet in Crime No.78 of 2022 in accordance with law.

¶2The earlier petition that was filed by the petitioner in Crl.O.P(MD) No.18908 of 2022, was closed by this Court, on the ground that the mediation process was pending between the parties and the learned Government Advocate (Crl. Side) submitted that after the mediation process is over, further process will be undertaken. On the above said submission of the learned Government Advocate (Crl. Side), the petition was closed on 14.11.2022.

¶3Now the grievance of the petitioner is that even after failure of the mediation process, Anticipatory Bail application was allowed by this Court to the accused with some sort of conditions in Crl.O.P(MD) No.21040 of 2022, dated 21.03.2023. The above said conditions have not been complied by the accused, inspite of that, no arrest has been effected by the respondent.

¶4Reading of the above said order of anticipatory bail shows that in a scheduled manner, accused was directed to settle the entire amount of Rs.14,00,000/- (Fourteen Lakhs only). The first instalment was said to be paid on or before 28.03.2023 and the last instalment is due on

18.04.2023. Not even the first instalment has been paid by the accused so far, that is the grievance of the petitioner now. If it is so, the petitioner can workout her remedy through appropriate proceedings.

¶5In the mean time, the learned Additional Public Prosecutor would submit that within three months investigation will be completed and final report has been filed before the concerned trial Court.

¶6Recording the submission made by the learned Additional Public Prosecutor, the respondent is directed to complete the investigation and file a final report within a period of three months from the date of receipt of copy of this order.

¶7With the above said direction, this Criminal Original Petition is disposed of.
